Earth Air Heating & Cooling provides professional HVAC and indoor-air-quality services in Oceanside, CA and surrounding areas. We are licensed and bonded with the California Contractors State License Board (CSLB #1103686). All services are subject to availability and may vary by location.

4. Estimates Are Non-Binding

Online, phone, and in-person estimates are non-binding until you sign a written service or installation agreement. Quoted pricing may change due to hidden or concealed conditions discovered on site, building-code requirements, permit requirements, additional repairs discovered during diagnosis, customer-requested scope changes, and material availability or pricing changes. Any price change will be communicated for your approval before the additional work is performed.

6. Equipment & Workmanship Warranties

Manufacturer warranties on equipment and parts are provided by the equipment manufacturer and are subject to the manufacturer's terms, conditions, and registration requirements. Any workmanship warranty offered by Earth Air Heating & Cooling is governed by the signed installation or service agreement for your project. Nothing on this website creates or extends a warranty.

7. Emergency & Same-Day Service

Same-day, next-day, and emergency response times described on this website are based on technician availability and are not guaranteed. We prioritize urgent calls and will always give you our best available arrival window when you schedule.

8. Intellectual Property & License

All site content, logos, photos, and materials are owned by Earth Air Heating & Cooling or its licensors. Financing applications, maps, payment processors, and other third-party tools are governed by their own terms. Earth Air Heating & Cooling is not responsible for third-party services.

13. Website Availability

This website and its online tools may occasionally be unavailable due to maintenance, updates, or technical issues. We do not guarantee uninterrupted access.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARTH AIR HEATING & COOLING 'S TOTAL LIABILITY ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

16. Indemnification

You agree to indemnify and hold harmless RB Systems Inc (DBA Earth Air Heating & Cooling), its officers, owners, employees, contractors, agents, successors and assigns from claims arising from your misuse of the site or violation of these Terms.

17. Force Majeure

Earth Air Heating & Cooling is not liable for delays or failures in performance caused by events beyond our reasonable control, including severe weather, utility outages, supply-chain delays, manufacturer shortages, natural disasters, and government actions or orders. We will communicate promptly and reschedule affected work as soon as reasonably possible.

18. Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Exclusive venue lies in state or federal courts located in San Diego County, California, except as provided in the arbitration section below.

19. Binding Arbitration & Class-Action Waiver

Disputes arising out of or relating to these Terms or our services shall be resolved by binding individual arbitration under AAA Consumer Rules in San Diego County, California. You may opt out within 30 days of first accepting these Terms by emailing [email protected] with subject "Arbitration Opt-Out." Class actions and class arbitrations are waived.

20. Dispute Notice Procedure

Before filing arbitration or court action, the parties will attempt to resolve disputes by written notice to [email protected] or 4042 Olive Dr, Oceanside, CA 92056, allowing 30 days to respond.

21. Pricing, Billing & Financing

Final pricing is per the signed service or installation agreement. Unless otherwise agreed in writing, payment is due in full upon completion of the work. Installation projects may require a deposit and payment for special-order materials before work is scheduled. Returned checks may incur a returned-check fee to the extent permitted by California law. Past-due balances may accrue late charges as stated in your signed agreement, and you are responsible for reasonable collection costs where permitted by law. Financing is offered through third-party lenders subject to credit approval. Earth Air Heating & Cooling is not a lender and does not guarantee approval, rates, or terms.

22. Termination

We may suspend or terminate your access to the site at any time for any reason, including violation of these Terms.

23. Severability & Entire Agreement

If any provision is unenforceable, the remainder stays in effect. These Terms and our Privacy Policy are the entire agreement regarding site use and supersede prior agreements on that subject.

24. Text Messaging (SMS) Consent

If you provide your phone number and opt in through a form on this site, you consent to receive transactional and service-related text messages from Earth Air Heating & Cooling.
